1. Acceptance of Terms

By accessing or using WishYork, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

WishYork is a social wishlist platform that allows users to create and share wish lists, participate in collective gifting, plan events, and join gift-exchange draws (SecretYork). We also provide a platform for Non-Governmental Organizations (NGOs) to create donation campaigns.

3. User Accounts

We use Clerk for authentication and user account management. You are responsible for:

• Providing accurate information when creating an account.
• Maintaining the security of your account and credentials.
• All activities that occur under your account.

4. Acceptable Use

You agree not to use the service for any purpose that is prohibited by these Terms. You shall not:

• Post any illegal, offensive, or infringing content.
• Impersonate any person or entity.
• Attempt to interfere with the proper working of the Service.
• Use the service to distribute spam or unauthorized advertising.

5. Wish Lists and Content

Users retain ownership of the content they post on WishYork. However, by posting content (such as wish lists, images, and descriptions), you grant WishYork a worldwide, non-exclusive, royalty-free license to use, display, and distribute that content to provide the Service to you and other users according to your privacy settings.

6. SecretYork Draws

SecretYork is a random draw tool. While we facilitate the match between participants, WishYork is not responsible for the actual delivery, quality, or existence of any gifts exchanged between users. Participation is at your own risk.

7. NGO Campaigns

WishYork acts as a platform for NGOs to present their needs. We do not process direct donations and are not responsible for the actions, promises, or legal status of any NGO listed on the site. Please perform your own due diligence before contributing to a campaign.

8. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties.

9. Limitation of Liability

To the maximum extent permitted by law, WishYork shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul.
